Use of Loan Proceeds by Borrowers No restriction
Repayment Maximum repayment period is ten years. Borrowers may apply for a principal moratorium of 18 months from the drawdown of the loans. If a borrower does not fulfil the repayment obligations, it may adversely affect the borrower’s credit records maintained at the credit reference agencies. The lending bank will also follow up in accordance with its usual processes.

    Can I repayment my instalment loan amount in full early at any time?
    You may only repay the instalment loan in full (but not part of it) early if you notify us in writing ten business days before your proposed prepayment date. If you wish to repay your Loan early, you must pay the instalment loan in full, plus all accrued but unpaid interest up to the actual settlement date plus any other sum due to us. We will charge you an early settlement fee of 2.5% of the outstanding balance to cover our own administration fees and other costs.

Total amount to be paid is HKD130,851.67 with the following breakdown:

  1. Declaration of the Borrower
    借款人提供的聲明

    In this Declaration, unless otherwise specified, all references to a document shall include any subsequent amendment or supplement thereto from time to time.

    In consideration of the agreement of the HKMC and the HKMCI to consider the Lender’s offer (in relation to this loan) under the Scheme, the Borrower confirms and undertakes to the HKMC, the HKMCI, the Lender, TransUnion Limited and/or any other credit reference agencies (each a CRA) (as appropriate) that:
    就按揭證券公司和按證保險公司同意考慮貸款人在計劃下(與該貸款有關)的提議,現借款人向按揭證券公司、按證保險公司、貸款人、環聯資訊 有限公司和/或任何其他信貸資料機構(每個分別為「信貸資料機構」)(如適用)確認並承擔:
    1. the information given at any time in or for the purpose of this application is to the best of the Borrower’s knowledge and belief true, accurate, up-to-date and complete as at the date of its submission. The Borrower hereby authorises the Lender, the HKMC and the HKMCI to verify or confirm such information, directly or indirectly or through TransUnion Limited and/or any other CRA or from any source or in any manner as they may choose or deem appropriate, and to obtain on behalf of the Borrower within 90 days from the day of signing of this Form by the Borrower, a copy of the Borrower’s credit report from any CRA for the purposes of the commitment to purchase to be granted by the HKMC via the HKMCI relating to the Loan and other related purposes, and any other purposes in connection with the business of the HKMC or the HKMCI or any of its related bodies; in this connection, the Borrower consents to and authorises any CRA to provide a copy of the Borrower’s credit report directly to the HKMC or the HKMCI without having first sent the Borrower a copy of the credit report for review;
      借款人任何時候就此申請提供的資料,就其所知及相信,均屬真實、正確、最新和完整的。借款人謹此授權貸款人、按揭證券公司、按證保險 公司直接或間接或透過環聯資訊有限公司及/或任何其他信貸資料機構,或其選擇及認為適當的任何其他來源或方式核實或確認這些資料, 及代表借款人,自借款人簽署本表格90 天內,為貸款或其他相關目的或任何其他有關按揭證券公司或按證保險公司或其相關機構業務的 目的,從信貸資料機構獲取借款人信用報告的副本;因此,借款人同意並授權任何信貸資料機構,無需首先將借款人的信用報告副本發送給 借款人審閱而直接提交給按揭證券公司或按證保險公司;
    2. the Borrower hereby agrees and acknowledges to all CRAs that the provision of any credit report by any CRA to the HKMC or the HKMCI or the use of any such credit report by the HKMC or the HKMCI shall not be made the basis of any complaint, claim, suit, demand, cause of action or other proceeding against the CRA, the HKMCI or the Lender by the Borrower or any third party;
      借款人謹此同意並向所有信貸資料機構確認,任何信貸資料機構向按揭證券公司或按證保險公司提供的任何信用報告,或由按揭證券公司或 按證保險公司使用任何此類信貸報告,均不構成借款人或任何第三方對信貸資料機構、按揭證券公司、按證保險公司或貸款人提出任何投訴、 索賠、訴訟、要求、訴訟理由或其他法律程序的依據;
    3. the Borrower hereby agrees that a copy or an electronic record of this Form bearing its signature(s) (including electronic signature) shall for the purpose of this application (including this Declaration), have the same effect as if it were the original thereof;
      借款人謹此同意本表格的副本或者電子記錄,並附有其簽名(包括電子簽名)的,應作本申請(包括本聲明)之用,其效力與原件相同;
    4. the Borrower hereby authorises (a) the Lender, the HKMC, the HKMCI and their related bodies to access, inspect and make copies of all books, records, accounts and any other information relating to the Borrower or the Borrower’s business (for Borrower that is self-employed or a freelancer), whether in paper, electronic or any other form or medium and whether in the possession, custody or control of the Lender, the Borrower or otherwise, and (b) the HKMC or the HKMCI to disclose any information relating to the Borrower under the Scheme and/ or under the SME Financing Guarantee Scheme (SFGS) to the Lender, for any purpose relating to this application, monitoring the performance of the Loan, conducting quality assurance sampling review, due diligence review, processing a request for payment under the Scheme and other related purposes;
      借款人謹此授權(a) 貸款人、按揭證券公司、按證保險公司及其相關機構查閱、檢查和複製與借款人或借款人業務(對於自僱或自由職業者的 借款人)有關的所有簿冊、記錄、帳目和任何其他資料,無論是書面、電子或任何其他形式或媒介的亦無論是由貸款人、借款人或其他人士 管有、看管或控制的及(b) 按揭證券公司或按證保險公司向貸款人披露與借款人有關的在計劃及/或中小企融資擔保計劃項下的任何資料,目的 是為了本申請、跟蹤貸款表現、品質保證抽樣檢閱、盡職調查、處理計劃下的款項支付及其他相關事宜;
    5. the Scheme is for the sole and exclusive benefit of the Lender, and that the Borrower shall not be deemed to be a party to it, or a beneficiary of it, and that no payments made under the Scheme to the Lender shall affect or lessen the Lender’s rights of remedy against the Borrower in the event of default under the Loan;
      貸款人乃計劃下的唯一及獨有受益人,借款人不會被視為計劃下的合約一方或受益人,而根據計劃向貸款人支付的任何款項將不會影響或減少 貸款人因借款人違約而擁有之索償權;
    6. the Borrower is a Hong Kong permanent resident aged 18 years old or above;
      借款人為18歲或以上香港永久性居民;
    7. as at the date of this application, the Borrower is not an undischarged bankrupt and no bankruptcy petition or proceedings has been made against the Borrower;
      自申請之日起,借款人不屬於未獲解除破產人士及未有針對其的破產呈請或法律程序;
    8. the Borrower hereby undertakes to inform the HKMC, the HKMCI and the Lender as soon as practicable if any information provided by the Borrower in connection with this application is no longer valid, complete or accurate. The Borrower undertakes to repay in full all the outstanding amounts with respect to the Loan with interest within such time specified upon notification by the HKMC, the HKMCI or the Lender, if any information provided by the Borrower in connection with this application is false, inaccurate or no longer valid. The Borrower acknowledges that the HKMC, the HKMCI and the Lender reserve the right to take any actions, including legal actions, that are considered appropriate by the HKMC, the HKMCI and the Lender against the Borrower for furnishing false information;
      借款人謹此承諾如借款人就此申請提供的任何資料不再有效、完整或準確,會儘快在可行的情況下通知按揭證券公司、按證保險公司及 貸款人。借款人承諾,如果借款人就此申請提供的任何資料是虛假、不準確或不再有效的,在按揭證券公司、按證保險公司或貸款人通知的 規定的時間內,全額償還貸款的所有未償款項及利息。借款人確認,如借款人提供虛假資料,按揭證券公司、按證保險公司及貸款人保留採取 其認為適當的任何行動,包括法律行動,的權利;
    9. without prejudice to any rights and remedies that the Lender, the HKMC or the HKMCI may have, the Borrower acknowledges that the HKMC or the HKMCI may forthwith request the Lender to suspend the Loan, and the Lender shall act accordingly, in the event that the HKMC or the HKMCI is in the opinion that the Borrower is:
      在不影響貸款人、按揭證券公司或按證保險公司擁有的任何權利和補救措施的情況下,借款人確認,如果按揭證券公司或按證保險公司認為借款人有下列情形,按揭證券公司或按證保險公司可以要求貸款人、而貸款人因此暫停貸款:
      1. in breach of any of the undertakings given in this application; or
        違反本申請中作出的任何承諾;或
      2. no longer in compliance with, or has not complied with any declaration in this application;
        不再遵守或未遵守本申請中的任何聲明;

      Supporting documents 證明文件:
      (1) Bank statements or passbook of the Borrower’s main personal bank account(s) (and main business operating bank account(s) for self-employed business owner) for any 2 consecutive months issued within 3 months prior to the submission of loan application showing a loss of more than 50% main recurrent income from employment in Hong Kong (not applicable to business owners) or loss of main recurrent income from business in Hong Kong. Please note: Unless justified otherwise with proofs, the bank account shall be the same as that used to show the 3 months’ income proof mentioned in item 11 of this Loan Application Form.
      在提交貸款申請表前3 個月內的任何連續2 個月,借款人的個人銀行帳戶(及/或自僱經營人士的主要業務經營銀行賬戶)月結單或 賬戶存摺,證明已失去超過一半在香港就業(不適用於自僱經營人士)或失去在香港經營業務所得的主要經常性收入。請注意: 除非有其他證據,所用銀行帳戶應與本貸款申請表第11項中用來顯示3 個月的收入證明的帳戶相同。
      (2) Applicable to self-employed business owners
      Proof of filing of Notice of Cessation of Business to the Business Registration Office or completion of sale of sole proprietorship or partnership, or Form 1(a) or Form 1(c) of the Business Registration Office showing the Borrower ceased the business or ceased to be a sole proprietor or partner, as the case may be. Alternatively, the Borrower may provide (i) the latest statements or passbook of major bank account(s) (for 2 consecutive months issued within 3 months prior to the submission of this Loan Application) of the sole proprietorship, partnership, or privately owned limited liability company, as the case may be, showing no active account transactions arising from new business activities; (ii) the relevant Business Registration Certificate of the selfemployed business; and (iii) provide a declaration on section IV (Supplemental Information and/or Declaration provided by the Borrower) of this Loan Application Formto provide an explanation for those non-business related transactions, if any, and provide supporting documents, where applicable.

      (##) In view of the fact that Borrower who became unemployed, laid-off or whose business ceased (for self-employed business owner) in the first quarter of 2020 may not be able to provide proof of employment or business and main current income for at least three months during the specified period, the Lender may exercise discretion in dealing with such cases by considering the Borrower’s proof of employment or business and main current income for at least the three (3) months between July 2019 and February 2022.
      鑑於在2020 年第一季度失業,被停職或已停止其營業(適用於自僱經營業務人士)的借款人或未能提供指定期間至少3 個月的就業或經營 業務和主要經常性收入證明,貸款機構會將酌情處理有關個案,或考慮借款人從2019 年7 月至2022 年2 月期間至少三(3) 個月的就業或 經營業務和主要經常性收入證明作為依據。
      Supporting documents 證明文件:
      (1) Bank statements or passbook showing the autopay salary record (e.g. credit transaction with description of “salary”, “payroll”, employer’s name) for at least 3 months (as specified in item 11 of this Form);
      至少3 個月(如本貸款申請表第11 項所指明)銀行月結單或存摺顯示相關的自動轉賬薪金(例如顯示薪金、工資,僱主名稱描述的 收款條目);
      (2) Wage slips, wage receipts, or other documents (such as tax return or any official documents, e.g. termination letter, statement of final/severance payment showing the last salary and period of employment to the Borrower, annual statements for 2020 or 2021, or monthly contribution history of the MPF scheme or ORSO scheme) that can be relied on to confirm or deduce the daily or monthly wage in the 3 months (as specified in item 11 above) (collectively, “wage confirmations”), issued by the current and/ or former employer and supported by bank statement(s) or passbook showing record of bank transfer or deposits of cheque(s) or cash. For wage paid by cheques and the relevant wage confirmations are not available, a copy of the cleared cheques supported by proof of employment relationship between the Borrower and the cheque issuer(s);
      現時或前僱主發出的糧單或工資收據,或其他文件(例如顯示借款人最後薪金和在職期間的報稅表或任何正式文件,如終止合約 信函、最後/ 遣散費付款表、強積金或職業退休計劃的2020 或2021 年度報表,或每月供款記錄)可用來確認或推論借款人(如本貸 款申請表第11項所指明)的3個月的每日或每月工資(統稱為「工資確認文件」),並附上顯示相關收入由銀行轉帳或支票或現金存入 的銀行月結單或存摺。如收入由支票支付而未能提供相關工資確認文件,請提供銀行已處理支票的副本及文件以證明借款人與支票 付款方的僱傭關係;
      (3) Bank statements or passbook (including statements or passbook(s) of major bank account(s) of the Borrower’s sole proprietorship, partnership, or privately owned limited liability company, if appropriate, or free-lancers) showing records of business transactions, and supported by proofs of business activities for any 3 months (as specified in item 11 of this Form) which generated the main recurrent incomes. Examples of proofs of business activities include sales or service contract(s), invoice(s), or other records or correspondence(s) confirming remunerated jobs or projects of the Borrower;
      銀行月結單或存摺(包括借款人的獨資企業、合夥企業或具有限責任的私營公司(如適用)或自由職業者的主要銀行賬戶的月結單或 存摺)顯示相關商業交易記錄,並附上任何3 個月(如本貸款申請表第11 項所指明)的文件證明產生主要經常性收入的商業活動。 證明商業活動的文件包括:銷售或服務合同或發票或其他商業記錄或通信往來;
      (4) Tax demand note (including tax demand note of the Borrower’s sole proprietorship, partnership, privately owned limited liability company, if applicable) for financial year 2019/2020 or 2020/2021 or 2021/2022 with assessment details.

      1. Nothing in this Statement shall limit the rights of data subjects under the Personal Data (Privacy) Ordinance.

      2. The supply of personal data is voluntary except for the personal data specified in the relevant data collection form as obligatory. Failure to supply such obligatory data will prevent us from fulfilling the purposes described below.

      1. The purposes for which personal data of a data subject may be used will vary depending on the circumstances and context of its collection, but the purposes perceived by us will include the following:

        18. complying with the laws, regulatory requirements and any other rules, guidelines or orders of any applicable jurisdiction which we are expected to or would normally comply with;

        19. complying with any obligations, requirements, policies, procedures, measures or arrangements for sharing personal data and information within the HKMC Group and/or any other use of personal data and information for compliance with sanctions or prevention or detection of money laundering, terrorist financing or other unlawful or prohibited activities or conduct;
          遵守為符合制裁或防止或偵測清洗黑錢、恐怖分子融資活動或其他非法或禁止的活動或行為而制訂的按揭證券公司集團內共用個人資料和 資訊及/或其他個人資料和資訊使用而指 定的任何責任、要求、政策、程序、措施或安排;
        20. enabling an actual or potential assignee of us, or participant or sub-participant of our rights in respect of a data subject to evaluate the transaction intended to be the subject of the assignment, participation or sub-participation; and
          供我們的實際或潛在承讓人,或就我們對資料當事人享有權利的參與人或從屬參與人衡量有關轉讓、參與或從屬參與所涉交易;及
        21. purposes directly relating to any of the above.

        1. Personal data will be kept confidential but, subject to the provisions of any applicable law, may be provided to the following parties (within or outside Hong Kong) for the purposes outlined in paragraph 3 above:

          3. any co-applicant or co-borrower, and any person proposing to provide or providing any financial or credit support in relation to a data subject’s obligations in connection with our Services.

              Section Important Information - Personal Instalment Loan [IID-PL004.2 (09/2022)]

              Thank you for applying for our Personal Instalment Loan (“your Loan”). Please note the following key terms that are associated with your Loan:

              1. Your loan amount is set out in the approval letter. The minimum loan amount is HK$5,000.
              2. Your Loan is a type of instalment loan. Your first installment is due on the date set out in the Drawdown Advice. After that, you have to pay us each month until the amount we lent to you (plus interest) has been repaid.
              3. If you ask, subject to approval, we may agree to provide a top up loan on terms we notify.
              4. If you request a top up loan, the repayment period of the top up loan will be the same as your existing instalment loan, commencing on the date the top up loan is made. If you request, we may agree to extend the repayment period.
              5. If you are advanced a top up loan, we will adjust the dates and amounts of the new monthly repayments by notice to you.
              6. We will debit your repayment account for the instalment amount on the instalment due date.
              7. The interest rate on your Loan is set out in the approval letter. Interest is calculated on monthly basis. The Annualised Percentage Rate is also set out in the approval letter.
              8. We may vary the interest rate at any time. If we vary the instalment amount due to a change in the interest rate, the variation becomes effective on the second instalment date following the change in interest rate.
              9. We will not charge a handling fee in the drawdown amount.
              10. You may only repay the instalment loan in full (but not part of it) early if you notify us in writing ten business days before your proposed prepayment date. If you wish to repay your Loan early, you must pay the instalment loan in full, plus all accrued but unpaid interest up to the actual settlement date plus any other sum due to us. We will charge you an early settlement fee of 2.5% of the outstanding balance to cover our own administration fees and other costs.
              11. If you do not repay any monthly instalment on or before the relevant due date:
                1. the instalment loan plus all accrued but unpaid interest plus any other sum due to us is immediately due and payable; and
                2. we will charge you a late payment fee of HK$1,000.
                Standard Chartered Personal Instalment Loan Debt Consolidation Program

                If you have applied for our Personal Instalment Loan Debt Consolidation Program, the following terms in addition to the terms above apply:

                1. You agree to use the approved loan amount to settle the total or part of outstanding balances of your credit cards (other than Standard Chartered Credit Card/Standard Chartered Co-Branded Card/MANHATTAN Credit Card/MANHATTAN Co-Branded Card) or personal loans (other than loans provided by any member of the Standard Chartered Group). We reserve the right to request you to cancel or terminate any of your credit cards or personal loans.
                2. After we approve your loan application, within 5 working days, we will do any of the following:
                  1. deposit the approved loan amount to your designated credit card account(s) with other banks, where such bank(s) may deduct from the relevant account a handling fee for local telegraphic transfer; and
                  2. send the cashier’s order(s) with the approved loan amount to your correspondent address or deposit the approved loan amount to your repayment account of your relevant bank(s) or financial institution(s). After you have received the cashier’s order(s) or approved loan amount, you should settle the relevant loan(s) by depositing the amount(s) to your relevant loan account(s) with other bank(s) or financial institution(s) accordingly.

                  It sets out specific terms and conditions on which we agree to provide you with the products and services you applied here. You must read it in conjunction with our Client Terms, and the applicable documents referred to in Part A of Client Terms (including the Personal Loans/ Personal Line of Credit/Overdraft Terms and the product brochure , Important Notes and promotional terms (if applicable)) and any other documents forming our banking agreement. The banking agreement is available to you at any of our branches or our website at www. sc.com/hk. If there is any inconsistency between the approval and any other part of our banking agreement, then the terms in the approval prevails. These terms do not apply to any existing product(s) or service(s) you have with us to the extent that they are subject to separate terms and conditions.

                  Meaning of words

                  Other than the defined terms here or under the product brochure or promotional terms (if applicable), you also need to refer to the other documents that form our banking agreement which define key words used below. For instance, please note:-
                  you means the person named as the “applicant” in the application .
                  we (without limiting the meaning defined in Client Terms) or Bank means Standard Chartered Bank (Hong Kong) Limited for this application .

                  Important Notes
                  1. To be eligible for this personal instalment loan , your annual income has to be HK$96,000 or above.
                  2. We reserve the right to determine the loan amount, limit , minimum monthly repayment, interest rate or any other offer in respect of the loan applied, or to decline your application in its entirety without giving you any reason for doing so. If your application is declined, no contractual relationship arises between us and you in respect of any product or service requested in your application.
                  3. In case if your application is approved, the pricing (such as interest rate and handling fee) will be offered to you based on the credit record you submit to us upon your application. We reserve the right to modify such pricing offered to you by giving you 30 days advance notice based on our credit assessment from time to time including, but not only limited to, your repayment record, credit bureau grading and our prevailing credit policy.
                  4. We may have obtained a credit report on the client and any of its sureties from a credit reference agency in considering any application for credit. In the event the client or any of its sureties wishes to access the credit report, we will advise the contact details of the relevant credit reference agency.
                  5. We may set off any amount we owe you against any amount you owe us (whether or not the obligation is matured or contingent).
                  6. Without limiting the above, our “Notice to Customers and Other Individuals relating to the Personal Data (Privacy) Ordinance and the Code of Practice on Consumer Credit Data” (“ Notice ”, which is available to you at any of our branches and/or on our website at www.sc.com/hk) also forms part of the banking agreement. We will be using the information you provide to us and for such purposes as set out in the Notice .
                  7. We reserve the right to amend the contents and all the important notes or terms and conditions here at any time. In case of disputes, our decision shall be final.
                  8. If there is any inconstancy of conflict between the English and the Chinese versions, the English version shall prevail.

                  • ensure that you have sufficient funds in the account to be debited (including the repayment account);
                  • not stop cheques;
                  • not cancel or vary any payment arrangement (unless we ask you to do so to reflect a change in the instalments) or close or change the account on which cheques are drawn.
                  • organise a payment arrangement with the other financial institution under which an amount equal to each instalment amount is debited from the repayment account and paid to us on each instalment payment date and give us satisfactory evidence that this is in place; or
                  • provide us with any authority we require to enable us to debit the instalment amounts, from the repayment account .
                  • the instalment loan plus all accrued but unpaid interest plus any other sum due to us is immediately due and payable; and
                  • we will charge you a late payment fee as set out in the tariff sheet or elsewhere in our banking agreement.
                  • you give us reasonable notice in writing; and
                  • when you prepay, you also pay all accrued but unpaid interest, fees and charges in connection with the instalment loan (including any early settlement fees as set out in the tariff sheet or elsewhere in our banking agreement).                   Our Client Terms set out when you and we may end your use of any product and what you need to do if that happens. This includes immediate payment of the balance owing for the account for the instalment loan . This clause sets out additional circumstances in which you or we may cancel the instalment loan .

                  Notice to customers and other individuals relating to the Personal Data (Privacy) Ordinance (“Ordinance”) and the Code of Practice on Consumer Credit Data

                  1. From time to time, it is necessary for data subjects to supply the Bank with data in connection with matters such as:-
                  1. the opening or operation of accounts ,
                  2. the establishment, maintenance, review or evaluation of facilities; and/or
                  3. the establishment or operation or provision of products or services offered by or through the Bank (which include banking, cards , financial, insurance, fiduciary, securities and/or investments products and services as well as products and services relating to these);

                  6. assisting other credit providers in Hong Kong approved for participation in the Multiple Credit Reference Agencies Model (hereinafter referred to as “credit providers”) to conduct credit checks and collect debts;
                  7. ensuring ongoing credit worthiness of the data subject ;
                  8. designing banking, cards , financial, insurance, securities and investment services or related products for data subject’s use;
                  9. marketing services, products and other subjects (please see further details in paragraph (g) below);
                  10. determining the amount of indebtedness owed to or by data subjects ;
                  11. enforcement of data subjects ’ obligations, to the Bank or any other member of the Standard Chartered Group , including but not limited to the collection of amounts outstanding from data subjects and those providing security for data subjects ’ obligations;
                  12. meeting or complying with any obligations, requirements or arrangements for disclosing and using data that apply to the Bank or any other member of the Standard Chartered Group or that it is expected to comply according to:-
                    1. any law or regulation binding on or applying to it within or outside Hong Kong existing currently and in the future (e.g. the Inland Revenue Ordinance and its provisions including those concerning automatic exchange of financial account information);
                    2. any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers within or outside Hong Kong existing currently and in the future (e.g. guidelines or guidance given or issued by the Inland Revenue Department including those concerning automatic exchange of financial account information); and
                    3. any present or future contractual or other commitment with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers that is assumed by or imposed on the Bank or any member of the Standard Chartered Group by reason of its financial, commercial, business or other interests or activities in or related to the jurisdiction of the relevant local or foreign legal, regulatory, governmental, tax, law enforcement or other authority, or self-regulatory or industry bodies or associations;
                    1. any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment or securities clearing or other services to the Bank in connection with the establishment, operation, maintenance or provision of Facilities, Products and Services ;
                    2. any other person under a duty of confidentiality to the Bank including any other member of the Standard Chartered Group which has undertaken to keep such information confidential;
                    3. the drawee bank providing a copy of a paid cheque (which may contain information about the payee) to the drawer;
                    4. third party service providers with whom the customer has chosen to interact with in connection with the customer’s application for the Bank’s products and services;
                    5. credit reference agencies (including the operator of any centralized database used by credit reference agencies), and, in the event of default, to debt collection agencies;
                    6. any person or entity to whom the Bank or any other member of the Standard Chartered Group is under an obligation or otherwise required to make disclosure under the requirements of any law or regulation binding on or applying to the Bank or any other member of the Standard Chartered Group , or any disclosure under and for the purposes of any guidelines, guidance, directives, rules, codes, circulars or other similar documents issued or given by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers with which the Bank or any other member of the Standard Chartered Group is expected to comply, or any disclosure pursuant to any contractual or other commitment of the Bank or any other member of the Standard Chartered Group with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers, all of which may be within or outside Hong Kong and may be existing currently and in the future;
                    7. any financial institution and merchant acquiring company with which a data subject has or proposes to have dealings;
                    8. any actual or proposed assignee of all or any part of the business and/or asset of the Bank or participant or sub-participant or transferee of the Bank’s rights in respect of the data subjects ;
                    9. any party giving or proposing to give a guarantee or third party security to guarantee or secure the data subject’s obligations; and/or
                      1. any member of the Standard Chartered Group which may include a Head Office function acting as a data controller in respect of data subject’s data;
                      2. third party financial institutions, insurers, credit card companies, securities and investment, mobile wallets & digital payment services providers;
                      3. third party reward, loyalty, co-branding and privileges programme providers;
                      4. co-branding partners of the Bank and/or any member of the Standard Chartered Group (the names of such co-branding partners can be found in the application form(s) for the relevant services and products, as the case may be);
                      5. charitable or non-profit making organisations; and
                      6. external service providers (including but not limited to mailing houses, telecommunication companies, telemarketing and direct sales agents, call centres, data processing companies and information technology companies) that the Bank engages for the purposes set out in paragraph (d)(ix) above
                      1. With respect to data in connection with mortgages applied by a data subject (in any capacity) on or after 1 April 2011, the following data relating to the data subject (including any updated data of any of the following data from time to time) may be provided by the Bank, on its own behalf and/or as agent, to credit reference agencies:-
                        1. full name;
                        2. capacity in respect of each mortgage (as borrower, mortgagor or guarantor, and whether in the data subject’s sole name or in joint names with others);
                        3. Hong Kong Identity Card Number or travel document number;
                        4. date of birth;
                        5. correspondence address;
                        6. mortgage account number in respect of each mortgage;
                        7. type of the facility in respect of each mortgage;
                        8. mortgage account status in respect of each mortgage (e.g., active, closed, write-off (other than due to a bankruptcy order), write-off due to a bankruptcy order); and
                        9. if any, mortgage account closed date in respect of each mortgage.
                        1. considering mortgage loan application(s) made by the data subject (in any capacity) from time to time;
                        2. reviewing any credit facility (including mortgage loan) granted or to be granted to the data subject (in any capacity) which is in default for a period of more than 60 days with a view to putting in place any debt restructuring, rescheduling or other modification of the terms of such credit facility by the Bank;
                        3. reviewing any credit facility (including mortgage loan) granted or to be granted to the data subject (in any capacity) , where there is in place any debt restructuring, rescheduling or other modification of the terms of such credit facility between the Bank and the data subject consequent upon a default in the repayment of such credit facility for implementing such arrangement;
                        4. reviewing any credit facility (including mortgage loan) granted or to be granted to the data subject (in any capacity) , with a view to putting in place any debt restructuring, rescheduling or other modification of the terms of any credit facility initiated by the request of the data subject ; and/or
                        5. reviewing, evaluating and modifying terms of any credit facility (including mortgage loan) granted or to be granted to the data subject (in any capacity) from time to time, and reviewing the same with the data subject .
                        1. reviewing and renewing mortgage loans granted or to be granted to the data subject (in any capacity) ; and/or
                        2. considering the application for credit facility (other than mortgage loan) by the data subject ( in any capacity other than mortgagor) and/or reviewing or renewing any facility (other than mortgage loan) granted or to be granted to the data subject ( in any capacity other than mortgagor), in each case where such facility is in an amount not less than such level or to be determined by a mechanism as prescribed or approved by the Privacy Commissioner for Personal Data from time to time.
                        1. the name, contact details, products and services portfolio information, transaction pattern and behaviour, financial background and demographic data of a data subject held by the Bank from time to time may be used by the Bank in direct marketing;
                        2. the following classes of services, products and subjects may be marketed:-
                          1. financial, insurance, fiduciary, investment services, credit card, securities, investment, banking and related services and products;
                          2. reward, loyalty or privileges programmes and related services and products;
                          3. services and products offered by the Bank’s co-branding partners (the names of such co-branding partners can be found in the application form(s) for the relevant services and products, as the case may be); and
                          4. donations and contributions for charitable and/or non-profit making purposes;
                          1. any member of the Standard Chartered Group ;
                          2. third party financial institutions, insurers, credit card companies, securities and investment, mobile wallets & digital payment services providers;
                          3. third party reward, loyalty, co-branding or privileges programme providers;
                          4. co-branding partners of the Bank and/or any member of the Standard Chartered Group (the names of such co-branding partners can be found in the application form(s) for the relevant services and products, as the case may be); and
                          5. charitable or non-profit making organisations;
                          1. to check whether the Bank holds data about him and/or access to such data;
                          2. to require the Bank to correct any data relating to him which is inaccurate;
                          3. to ascertain the Bank’s policies and procedures in relation to data and to be informed of the kind of personal data held by the Bank and/or he/she has access to;
                          4. to be informed on request which items of data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of access or correction requests to the relevant credit reference agency(ies) or debt collection agency(ies); and
                          5. in relation to any account data (including, for the avoidance of doubt, any account repayment data) which has been provided by the Bank to a credit reference agency, to instruct the Bank, upon termination of the account by full repayment, to make a request to the credit reference agency to delete such account data from its database, as long as the instruction is given within five years of termination and at no time was there any default of payment in relation to the account , lasting in excess of 60 days within five years immediately before account termination. Account repayment data includes amount last due, amount of payment made during the last reporting period (being a period not exceeding 31 days immediately preceding the last contribution of account data by the Bank to the credit reference agency), remaining available credit or outstanding balance and default data (being amount past due and number of days past due, date of settlement of amount past due, and date of final settlement of amount in default lasting in excess of 60 days (if any)).
                          1. an increase in the credit amount;
                          2. the curtailing of credit (including the cancellation of credit or a decrease in the credit amount); and
                          3. the putting in place or the implementation of a scheme of arrangement with the data subject or the third party.
                          1. the Bank or any other member of the Standard Chartered Group will use profiling, including behavioral analysis, to assist in providing data subjects with better Facilities, Products and/or Services , to make decisions and to prevent money laundering, terrorism, fraud and other financial crime, for example profiling will help to try and detect whether use of a credit card may be fraudulent. If any profiling will result in an automated decision relating to a data subject who is an accountholder , we will let the accountholder know and the accountholder will have the right to discuss the decision with the Bank;
                          2. in some circumstances a data subject has the right to ask the Bank to delete the personal data of such data subject , for example if the Bank no longer has a valid reason to process it;
                          3. in some circumstances a data subject may have the right to object to how the Bank processes the personal data of such data subject but this does not mean that the data subject can decide or choose how the Bank processes the personal data other than in relation to marketing. If a data subject has any concerns about how the Bank processes his/her/its personal data, such data subject should discuss this at a branch or with a relationship manager. The Bank may not be able to offer Facilities, Products or Services if the data subject does not want the Bank to process the personal data the Bank considers necessary to process to provide such Facilities, Products or Services ;
                          4. in some circumstances a data subject may have the right to restrict how the personal data of such data subject is processed;
                          5. in some circumstances a data subject may have the right to request the personal data that has been given to the Bank in a machine readable format. An accountholder may already be able to do this through online banking in relation to banking transactions;

Regardless of where personal data is transferred, the Bank takes all steps reasonably necessary to ensure that personal data is kept securely.
                          2. Data subject(s) should be aware that the Internet is not a secure form of communication and they must not send the Bank any personal data over the Internet as this carries with it risks including the risk of access and interference by unauthorised third parties. Information passing over the Internet may be transmitted internationally (even when sender and recipient are located in the same country) via countries with weaker privacy and data protection laws than in the country of residence of a data subject .

                          account(s) means, for each facility, service or product which the Bank may from time to time make available to the data subjects , the account that is, opened and/or maintained in respect of it from time to time.
                          accountholder(s) means holder(s) of an account , and includes joint accountholder(s) in case there is more than one holder for an account .
                          card means an ATM card, a debit card, a credit card, or a revolving card or all of them, as the context requires.
                          data subject(s) has the meaning given to it in the Ordinance and includes applicants or accountholders for Facilities, Products and Services , customers, security providers, guarantors, referees, corporate officers and managers, (e.g. authorized signatories, contact persons, company secretary, directors, shareholders, beneficial owners of a corporate), beneficiaries, suppliers, agents, contractors, service providers and other contractual counterparties and any third party transacting with or through the Bank.
                          disclose, disclosing or disclosure , in relation to personal data, includes disclose or disclosing information inferred from the data.
                          Hong Kong means the Hong Kong Special Administrative Region.
                          in any capacity means whether as a borrower, mortgagor or guarantor and whether in the data subject’s sole name or joint names with others.
                          mortgage count means the number of mortgage loans held by the data subject (in any capacity) with credit providers in Hong Kong from time to time.
                          Standard Chartered Group means each of or collectively Standard Chartered PLC and its subsidiaries and affiliates (including each branch or representative office).
                          Please circulate this document to any and all data subject(s) relating to your account(s) at our Bank. Should there be any inconsistencies between the English and Chinese versions, the English version shall prevail.
